Attorney work product is generally privileged, meaning that it is exempt from discovery by the opposing party. There are two categories of work product. Ordinary work product includes basic facts and interviews with witnesses, and may be discoverable if the opposing party can show substantial need, such as when a witness that has been previously interviewed becomes unavailable. By contrast, Opinion work product consists of an attorney’s mental impressions, ideas or trial strategies, and is not subject to discovery.
