In any legal proceeding issues to be determined may be of fact or of law. A question of fact is resolved by the “trier of fact,” which may be a jury in a jury trial or a judge in a bench trial (at trial before a judge without a jury). By contrast, a question of law is always resolved by a judge. In cases involving the law of foreign countries the law of that country is viewed as fact not law and must proven like any other fact.
